Terms of Use

These terms of use (‘Terms’) govern use of the website www.countryguides.travel and www.navgu.com (‘Website’). Your use of the Website will mean you accept these Terms. These Terms may be amended at any time by posting a revised version of the Terms on this website. The amended Terms would take effect from the time of posting on the web site.

Definitions

  • The “Provider” is Global Safety Net Pty Ltd (ABN 61 107 548 658) trading as Navgu;
  • A “Subscription” means the customers right to use the Service for a predefined period;
  • The “Service” includes provision of access to single country guides within the Website;
  • The “Customer” is a travel agency nominated as the sole subscriber and user of information supplied and presented by the Provider;

Subscriptions

All subscriptions to this Website commence on the date of application by an authorised representative of the Customer and continue for fifty two weeks from this date or until the Provider deems it necessary to end the subscription.

Each Subscription allows access to the service for up to seven individuals employed by the customer at a single travel agency office.

All customers are entirely responsible for all activities which occur under their username and password, or other usernames and passwords registered to their company, even if such activity was unauthorised or undertaken without their consent.

A subscription to Country Guides licences the customer to provide copies of the guides in either electronic or printed form to their direct retail clients only. The service does not include a licence for a customer to forward a Country Guide to a second company that is acting as a retail outlet on behalf of the customer.

Customers agree not to share or disclose their username and password or any username and password registered to their subscription to any person or organisation outside of their geographical office without the express permission of Global Safety Net. Each username and password may only be disclosed to a single person for his or her individual use.

The Customer agrees to notify Global Safety Net immediately if they become aware of any unauthorised use of their username and password or any username and password registered to their subscription.

Payment

Payments are made in advance in 12 months instalments. Before the completion of the subscription period, an invoice for the following period will be forwarded to customer offices. If a customer does not wish to receive this invoice, they must advise the provider in writing at least one month before the expiration of their subscription. If payment for the additional period is not received by the end of the last fully paid subscription, the provider retains the right to cancel all services to the customer. After each payment an electronic receipt will be issued by the provider to the customer.

External sites

This web site may contain links to, or frame, web sites of third parties (“external sites”). Links to, or framing of, external sites should not be construed as any endorsement, approval, recommendation or preference by Global Safety Net of the owners or operators of the external sites, or for any information, products or services referred to on the external sites unless expressly indicated on this web site. The provider makes no warranties and accepts no liability in relation to material contained on external sites.

Copyright

The material published within the Website is copyright protected. Customers are permitted to use this material for their own reference or for that of their direct clients only. Customers may print or email this material only on the day on which it is downloaded from the Website. Customers may not use any part of the published material of the provider to establish, maintain or provide, or assist in establishing, maintaining or providing their own publications, website or other means of distribution.

Copyright in all artistic and literary works authored by the provider shall remain the property of the provider unless there is a written agreement to the contrary. The customer warrants to the provider, that the customer has copyright in or a licence to authorise the provider to reproduce all artistic and literary works supplied by the customer to the provider for the purpose of producing and publishing Country Guides. The customer expressly authorises the provider to reproduce all and any of such works for the purposes of producing and publishing Country Guides.

The Customer indemnifies and agrees to keep the provider indemnified against all liability, losses or expenses incurred by the provider in any way directly or indirectly connected with any breach of copyright or of any rights in relation to copyright in materials supplied by the customer. Conditional upon receipt of payment in full for the work performed by the provider, the provider grants to the customer a non-exclusive license to use the copyright in works created by the provider for the purposes of the Order.

Limitation and exclusion of liability

The Customers ability to access the internet and the individual country guides is the sole responsibility of the customer. By logging on, the customer will be assuming all risks associated with use of the site, including the risk of their computer, software or data being damaged by any virus which might be transmitted or activated via the providers site or the customers access to it.

The provider will endeavour to provide the most accurate information available. However due to its ever changing character, the provider will not be held responsible for information which subsequently becomes incorrect after advice has been given as a result of changes.

While every care has been taken in the preparation of this travel information, and to the best of the providers knowledge it is correct at the time of publication, as much of the information is drawn from third parties, the provider does not accept liability for any errors or omissions and cannot warrant that the information contained within is complete or accurate and does not assume and hereby disclaims liability to any person for any loss or damage caused by errors or omissions in the Website whether such errors or omissions result from negligence, accident or any other cause. All Customers and end users utilising these guides are encouraged throughout the guide to verify any information they feel is important with the relevant authority (particularly regarding visas, vaccination & travel advice).

Save as otherwise provided herein, the Provider shall in no circumstances whatsoever or howsoever arising be liable for direct or indirect or consequential loss or damage. The defences and limits provided for in this contract shall apply in any action against the Provider for loss or damage or delay whether the action founded in contract, tort, or otherwise. It is specifically agreed that all rights, immunities and limitations of liability granted to the Company by the provisions set forth in this contract shall continue to have full force and effect in all circumstances and notwithstanding any breach of the contract or any condition hereof by the Company.

In the unlikely event of a dispute regarding the accuracy or validity of any information given, the provision of compensation by the provider is entirely at the discretion of the provider, and does not acknowledge any liability on behalf of the provider. Only advice or information in a documentary form will be considered when resolving the dispute and determining what, if any, compensation is appropriate. The level of compensation will be determined solely by the provider as a result of the individual circumstances.

Notices
The customer agrees to inform the provider in writing if:

  • they change the location of the office that is licensed to use the Website;
  • they no longer hold the rights to reproduce the logo that they have uploaded to the site;
  • any staff licensed to access the website under the customers subscription terminate their employment with the customer;
  • they believe there is any information that the provider should be aware of about the customers ability to comply with this Agreement.

Governing Law

The laws of New South Wales, Australia govern this Agreement. The parties submit to the non-exclusive jurisdiction of the laws of New South Wales, Australia.
